Rental Rules & Policies

Rental Requirements

  • All boat renters must be at least 21 years old

  • All captains must have a valid driver's license.

  • Must have a valid credit card or cash in the amount of $500.00 for a required security deposit for every rental. The deposit will be fully refunded provided that there is no damage to the rental vehicle and that the boat is returned by the scheduled time to our docks.

  • For CHARTERS- must have a valid credit card or cash amount of $100.00 for required security deposit for the charter vessel. The deposit will be fully refunded provided that there is no damage to the charter vessel or any lost items. 

  • All captains must have a valid boaters license or boating safety certification if they are born after January 1, 1982. If the captain is born before January 1, 1982, then they do not need a boaters license or boating safety certification.

  • If you do not have a boaters license or a boating safety certification, you can take the course here: www.boat-ed.com/pennsylvania This course will get a license that is good for life!

  • We offer a temporary certification course (resort course) here at our facility! This certification is only good for the period of your rental, costs and additional $125.00, and takes about 45 minutes to complete. 

Rental Policy

  • Pocono Action Sports has the right to refuse, at its sole discretion, to rent to any person they feel is not qualified to operate the watercraft safely.  This includes if a person does not have the right qualifications by law, or is under the influence of drugs or alcohol.

  • Any guest who is planning on partaking in watersports MUST be wearing a life jacket while partaking in watersports. 

  • Any guest 12 years of age or younger MUST wear a life jacket at all times while on board the vessels. 

  • All safety equipment is provided at no additional charge. This includes an anchor.

  • Boat occupancy cannot exceed the boat capacity listed for each boat.

  • Pets are not permitted on our rental boats.

  • Grilling or Barbecuing is not permitted on our rental boats.

  • Rental pricing does not include tax or gas. Renters will be responsible for amount of gas they have used.

  • Rental agreement and boat inspection check-out must be completed by a Pocono Action Sports Staff Member and renter before the rental craft can depart the dock.

  • Upon return, there will be a check-in and inspection of the rental craft.

  • The rental craft is due back by the time specified on the rental agreement. A late fee will be deducted from the security deposit if the boat is returned late.

  • Children and infants count towards the maximum occupancy.

Rental Policy
Cancellation Policy

  • Cancellation-

    • Cancellation policy is based on booking creation date and departure date of rental.

    • CANCELLATIONS MADE WITHIN 24 HOURS OF THE BOOKING CREATION DATE RECEIVE A FULL REFUND, otherwise cancellation refunds follow the policy below. (This excludes your rental if you added the cancellation insurance policy).

  • Refund Schedule:

    • Greater than 1 month prior to departure date: 50% refund

    • 2-4 weeks prior to departure date: 25% refund

    • 1-2 weeks prior to departure date: 15% refund

    • Less than 1 week prior to departure date: 10% refund

    • If the booking is made within 24 hours of rental departure, no refunds will be provided.

  • You can reschedule up to 1 week prior to the start of your reservation based on our availability. That rescheduled booking is not able to be cancelled for a refund of any kind or rescheduled again.

  • Cancelation Insurance:

    • Cancellation insurance gives you the most options in modifying your booking. This will protect you and your rental by giving you the option to cancel up to two days before your rental and receive a full refund. You must cancel by 9:00am two days BEFORE your rental. All cancellations must be made up to two days before your rental. This policy is for the entirety of your booing and can only be used to modify the entirety of your booking. You can purchase this through our add-on menu on your invoice, or give us a call. This is only available at the time of booking. ​

    • Cancellation Insurance is a non-refundable item.  

  • No Shows:

    • No shows will be charged the full amount of the rental.

  • Inclement Weather:

    • Pennsylvania's summer weather is very unpredictable. We do not offer any kind of refund due to possible inclement weather. In the event that unsafe boating conditions are present at the time of your reservation (pickup), you will be given a rain check which is good for one calendar year due to unsafe boating conditions. Rain alone is NOT considered unsafe boating conditions. Pocono Action Sports holds the right to determine unsafe boating conditions.

    • If you are cut short in the middle of your rental due to weather, we will provide you with a raincheck coupon for the time you lost. The amount will be prorated against the original booking price paid. If this were to occur, you will need to stop back at our rental desk to receive to the coupon code before leaving.

Damage Waiver Policy 

Pocono Action Sports rental property damage waiver limits a renter’s financial liability to Pocono Action Sports to $500.00 in situations involving an accidental collision between the renter and another vessel. By accepting this property damage waiver, I agree with the following terms and conditions:

​​​The waiver DOES cover: 

  • Property damage to the renter’s contracted boat only, caused by accidental collision while under power. 

​

The waiver DOES NOT cover: 

  • Damage caused by negligence or failure to operate the boat in a careful or prudent manner. 

  • Failure to observe and comply with navigational markers, Pennsylvania boating laws, or the instruction of the Pocono Action Sports Staff. 

  • Boating under the influence of alcohol or drugs. 

  • Dents, scratches, or any other damage caused by tying boats together, towing other vessels, or towing accessories. 

  • Damages caused by usage/allowance of prohibited items such as pets, grills, lanterns, or other combustible items. 

  • Any damages to the propellor or engine. 

  • Does not cover any type of liability only property damage to rented craft during designated rental period.

  • Does not cover damage caused by towing/and or launching a watercraft.

An accident report completed by the Pennsylvania Fish and Boat Commission is required to substantiate all claims. No waiver will be accepted without this documentation.


This waiver covers damage sustained only during the contracted rental times.  

 

The waiver does not provide any coverage other than that which is specifically stated above. The waiver applies to the renter’s contracted boat only and does not offer coverage of any other boat or property.
